Terms of Service

TERMS OF SERVICE

Effective date: February 14, 2026

The following terms constitute a binding agreement (the "Agreement") between you (the "Customer") and the developer of PandaPing (the "Service Provider") regarding the use of the PandaPing monitoring service (the "Service"). By making a payment or using the Service, you accept all terms set forth below.

The current version of these Terms is always available at pandaping.io/en/terms.

I. Definitions

Service — the PandaPing uptime monitoring platform, including all features, tools and interfaces accessible at pandaping.io.

Customer — any individual or legal entity that uses the Service, whether on a free or paid basis.

Dashboard — a unique monitoring workspace identified by a URL slug, containing the Customer's monitored hosts, settings and incident history.

Dashboard Link — the unique URL that serves as the Customer's access credential to a Dashboard. The link acts as the account identifier.

Coins — the internal virtual currency used to purchase premium features within the Service.

II. Subject of the Agreement

2.1. The Service Provider grants the Customer access to the Service for the purpose of monitoring the availability of servers, websites and network services.

2.2. Paid features are activated upon payment. Detailed descriptions, pricing and terms are published on the Service website.

2.3. The Customer pays the Service Provider a fee as specified in the pricing section of the website.

III. General Terms & Conditions

3.1. The Agreement is considered concluded from the moment the Customer makes a payment for any paid feature or coin pack.

3.2. Free usage (up to 3 monitored hosts) does not require payment and is available indefinitely, subject to these Terms.

3.3. The Customer is solely responsible for keeping their Dashboard Link confidential. The Service Provider is not liable for unauthorized access resulting from link disclosure.

3.4. The Service Provider may engage third parties to fulfill its obligations under this Agreement.

3.5. The Service Provider's obligations are considered fulfilled:

  • For monitoring slots — upon activation of the slot on the Customer's account;
  • For premium features — upon activation and for the duration specified;
  • For coin packs — upon crediting the coins to the Customer's balance.

3.6. The Service Provider reserves the right to refuse service if:

  • Payment has not been received or was received in an insufficient amount;
  • The Customer uses the Service in violation of these Terms;
  • The Customer's activity causes harm to the Service or other users.

3.7. The Customer confirms they are at least 18 years of age (or 14 with parental consent) and possess the legal capacity to enter into this Agreement.

IV. Rights and Obligations

4.1. The Customer shall:

  • Review and accept these Terms before using paid features;
  • Keep Dashboard Links confidential and not distribute them to unauthorized parties;
  • Use the Service only for lawful purposes;
  • Not attempt to disrupt, overload, or reverse-engineer the Service;
  • Provide accurate information when required.

4.2. The Customer may:

  • Use the free tier without any payment obligations;
  • Request a refund before a paid feature is activated;
  • Contact the Service Provider with questions or complaints.

4.3. The Service Provider shall:

  • Provide the Service in accordance with the published descriptions;
  • Make reasonable efforts to ensure uptime and reliability;
  • Publish accurate and up-to-date pricing information.

4.4. The Service Provider may:

  • Modify these Terms with notice posted on the website;
  • Change pricing for features not yet purchased;
  • Suspend or terminate accounts that violate these Terms.

V. Payment Terms

5.1. Paid features require full prepayment before activation.

5.2. Payments are processed through third-party payment providers. The Service Provider does not store payment card details.

5.3. All prices are displayed in the currency corresponding to the Customer's selected language (USD, RUB, or UAH).

5.4. The Service Provider may change prices at any time. Changes do not affect previously completed purchases.

5.5. Transaction fees, if any, are borne by the paying party.

VI. Intellectual Property

6.1. All content, code, design elements, trademarks and materials of the Service are the intellectual property of the Service Provider.

6.2. The Customer shall not copy, modify, distribute or reverse-engineer any part of the Service without explicit written permission.

6.3. No intellectual property rights are transferred to the Customer as a result of this Agreement.

VII. Liability

7.1. The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

7.2. The Service Provider is not liable for any indirect, incidental, or consequential damages arising from the use of the Service.

7.3. The Service Provider is not liable if the Customer fails to use an activated feature within its validity period.

7.4. The Customer is responsible for any damage caused by their misuse of the Service.

7.5. The parties shall attempt to resolve any disputes through negotiation. The response time for complaints is 30 calendar days.

VIII. Force Majeure

8.1. Neither party shall be held liable for failure to perform obligations due to force majeure events (natural disasters, government actions, infrastructure failures, etc.).

8.2. The affected party must notify the other party within 3 calendar days of a force majeure event.

8.3. If a force majeure event continues for more than 30 days, either party may terminate this Agreement with 30 days' written notice.

IX. Amendments and Termination

9.1. The Service Provider may amend these Terms at any time. The updated version takes effect upon publication on the website.

9.2. If the Customer disagrees with updated Terms, they must cease using paid features of the Service.

9.3. Invalidity of any provision does not affect the validity of the remaining provisions.

9.4. For one-time purchases (e.g., monitoring slots, coin packs), the Agreement is fulfilled upon delivery and considered complete.
